𝐋𝐚𝐰𝐲𝐞𝐫 𝐀𝐧𝐠𝐞𝐥𝐚 𝐌𝐮𝐥𝐰𝐚 𝐑𝐞-𝐚𝐫𝐫𝐞𝐬𝐭𝐞𝐝, 𝐒𝐞𝐭 𝐭𝐨 𝐅𝐚𝐜𝐞 𝐌𝐮𝐫𝐝𝐞𝐫 𝐂𝐡𝐚𝐫𝐠𝐞 𝐎𝐯𝐞𝐫 𝐃𝐫 𝐕𝐢𝐜𝐭𝐨𝐫𝐢𝐚 𝐌𝐮𝐭𝐢𝐬𝐨’𝐬 𝐊𝐢𝐥𝐥𝐢𝐧𝐠

Lawyer Angela Mulwa has been re-arrested outside the Milimani Law Courts in Nairobi as the State moves to formally charge her with the murder of her stepmother, clinical psychologist Dr Victoria Nthunya Mutiso.

The development came on Monday, August 24, 2026, after the Office of the Director of Public Prosecutions (ODPP) confirmed that murder charges had been filed at the High Court against Mulwa, her mother Rose Mbithe Mulwa, also known as Rose Mbithe Ndeti, and her brother Chris Mulwa.

The murder case has been registered as High Court case E004 of 2026, according to court reports.

Prosecutor Jalson Makori told Milimani Senior Resident Magistrate Joan Mati that the filing of the murder case meant the State would no longer pursue a separate application seeking to detain Angela Mulwa for 14 more days while investigations continued.

The application was subsequently withdrawn and the file closed.Mulwa was taken back into police custody shortly after leaving court.

The development follows an earlier case in which Mulwa and her co-suspect, Nelson Masiga Makaralu, were granted a Sh1 million cash bond each over allegations involving a stolen Range Rover Sport valued at about Sh15 million.

Investigators said the vehicle was among property allegedly taken from a disputed parcel of land in Mlolongo.

The bond related to a separate investigation involving alleged vehicle theft, land-related offences and other claims. It did not prevent detectives from pursuing the murder investigation.

Court rejects jurisdiction challenge

Earlier on Monday, Magistrate Joan Mati dismissed Mulwa’s preliminary objection challenging the jurisdiction of the Milimani court to hear a separate application by the Directorate of Criminal Investigations (DCI).

The DCI had sought additional time to hold Mulwa as detectives investigated her alleged connection to Dr Mutiso’s killing.

The magistrate ruled that the question of whether the Milimani and Mavoko investigations were the same, overlapping or separate could not be settled through a preliminary objection and would require evidence to be considered properly.

However, the subsequent filing of the murder case at the High Court changed the position, with prosecutors withdrawing the detention application.

Land dispute at centre of investigation

Dr Mutiso was shot dead on July 29, 2026, while travelling in a vehicle in Nairobi’s Upper Hill area.

According to police accounts presented during the investigation, her vehicle was blocked near the junction of Mbagathi Link Road and Mawenzi Road before gunmen opened fire. She was taken to Kenyatta National Hospital, where she was pronounced dead.

The DCI has linked the killing to a long-running dispute over land in Mlolongo, Machakos County.

Investigators said the dispute involved LR No. 1504/13 and that Dr Mutiso had previously placed a caveat on the property.

The DCI said the circumstances surrounding an earlier eviction and demolition at the property were among the issues being examined as investigators tried to establish the motive for the killing.

The investigation has also focused on vehicles allegedly removed from the property. One of them, a black Range Rover Sport valued at about Sh15 million, was later recovered from premises associated with Mulwa, according to investigators.

DCI alleges earlier attempt on Dr Mutiso

Court documents have also raised allegations of an earlier attempt to kill Dr Mutiso.

The DCI alleges that on April 24, 2026, Mulwa was present when Sh300,000 was allegedly paid as a down payment for an earlier plan to kill Dr Mutiso.

Investigators say that attempt did not take place.Detectives have also alleged that Mulwa was in communication with a senior police officer whose firearm they suspect was used in the killing.

The claims form part of the evidence being relied upon by investigators and have yet to be tested in court.

The DCI has previously said it was examining CCTV footage, communication records and forensic evidence as part of the investigation.

Defence challenges State’s case

Mulwa’s lawyers, led by senior advocate Danstan Omari, have questioned the continued use of detention applications and argued that the State should present a substantive charge if it has sufficient evidence against their client.

The defence has also challenged attempts to move or initiate proceedings in different courts, arguing that the various cases involving Mulwa should not be used to circumvent existing court orders.

With the murder case now before the High Court, Mulwa is expected to face the formal charges alongside her mother and brother.

The three suspects remain presumed innocent unless and until proven guilty in court. The allegations contained in the investigation papers will have to be tested through the judicial process.

For Dr Mutiso’s family, friends and colleagues, the latest development marks a major step in a case that began with her killing in broad daylight and has since expanded into an investigation involving alleged land disputes, vehicle theft, reported threats and several suspects.
